1. Introduction

Welcome to Tabmydata. These Terms and Conditions ("Terms") govern your access to and use of our platform, website, services and tools (together, the "Services").

By accessing or using the Services, you agree to follow and be bound by these Terms. If you do not agree, do not use the Services.

Tabmydata is a service owned and operated by Shining Dawn FZ-LLC (licence no. 47024036, Ras Al Khaimah Economic Zone, RAKEZ), VUPR1291, Compass Building – Al Hulaila, Al Hulaila Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates ("Tabmydata", "we", "our" and "us"). Shining Dawn FZ-LLC is the contracting party for these Terms and the owner of the Services and their intellectual property. Our contact is support@tabmydata.com.

2. Nature of our services

Tabmydata is a financial markets and cryptocurrency analysis tool. It gathers and organizes data from multiple exchanges. We do not provide financial, investment or trading advice. Any data, chart or insight on the platform is for information only and is not a financial recommendation.

Key disclaimers

No financial advice. Tabmydata does not offer trading recommendations, investment strategies or financial advisory services. Any decision you make based on data from the platform is made at your own risk.
No trading or execution. We do not facilitate trading, execute transactions or hold customer funds. You place trades through third-party exchanges, at your own discretion.
Market risk. Cryptocurrency and financial markets involve significant risk, including the possible loss of capital. You are responsible for your own research and risk management.
Modeled data. Some figures, such as the levels on the Liquidation Heatmap, are estimates produced by a model. They are not real orders, not a forecast and may be wrong.
Order book data. Order book and heatmap data show orders that can be cancelled or changed at any time.
Alerts. Alerts can be delayed or fail. Do not rely on them for time-critical decisions.
Alpha. Tabmydata is currently in Alpha. Features may change, be unavailable or be discontinued, and data may contain errors.
As is. The Services are provided "as is" and "as available".
Data accuracy. We work to provide accurate and up-to-date market data. We do not guarantee that any information on the platform is accurate, reliable or complete.

3. Eligibility

By using Tabmydata, you confirm that:

You are at least 18 years old.
You are legally permitted to use the Services in your country or region.
You understand that cryptocurrency and financial market investments involve risk, and you take full responsibility for your decisions.

4. Your responsibilities

As a user of Tabmydata, you agree to:

Use the platform only for lawful purposes.
Not manipulate, extract or exploit data from the platform for unauthorized commercial use.
Keep any personal or account information you provide accurate and up to date.
Take responsibility for your own decisions based on information on the platform.
Not scrape, reverse engineer, or use automated tools to collect data or content from the Services, and not resell data from the Services, without our written permission. Some data belongs to third parties and is subject to their terms.

5. Profiles, messages and shared content

Profile and avatar. You may add a display name and an avatar to your account. Do not use a name or image that impersonates another person or that is unlawful or offensive.

Content you create or share. This includes workspace names, descriptions, cover images, saved lists and messages. You are responsible for it. You keep your rights in it. You grant Tabmydata a worldwide, non-exclusive, royalty-free license to host, store and display the content you choose to make public or share, only to run and improve the Services. We may sublicense it to our hosting and service providers for this purpose only. This license does not apply to your private workspaces or private messages, which we process only to provide the Services. The license ends when you delete the content or your account, except for copies kept in backups for a limited time. You confirm that you own or have the right to share the content, and that it does not infringe anyone's rights (including copyright in images you upload).

Public and shared workspaces. If you make a workspace public, other users can see its card (name, description, cover image, number of tabs and when it was last updated) in the workspace gallery. Viewing the full workspace requires a login. If you share a tab or a workspace by link, people who have the link can view it. You can switch a workspace back to private or stop sharing at any time.

Messages, friends and blocking. The Services let you message other members, add friends and block members. Use these features lawfully and respectfully. Do not send spam, harass others, or share unlawful content. You can block any member at any time.

Alerts through other services. Personal alerts sent to Discord, by email or by push are delivered by third-party services under their own terms. Our public Telegram channel is a broadcast channel on Telegram that carries market-wide alerts for everyone; it does not carry personal alerts. Once an alert is delivered, we do not control it, and we do not guarantee delivery or timing.

Discord webhook. If you add a Discord webhook URL to receive alerts, you confirm that you are allowed to post to that channel. Keep the URL secret. We will send alerts to it according to your settings.

Moderation. We may remove content, or limit or suspend features or accounts, if content or conduct breaches these Terms (see section 11, Termination and suspension). Where reasonably possible we tell you why and give you a chance to respond, except where urgent action is needed for security, legal reasons or to protect other users. To ask us to review a decision, write to support@tabmydata.com.

Reporting content. To report content that infringes your rights or is unlawful, write to support@tabmydata.com with: what the content is and where it is, which right it infringes, your contact details, and a statement that you are the rights holder or are authorized to act for them. We may remove content, and may suspend accounts of repeat infringers.

Not advice. Content shared by other users, including workspaces and messages, is not financial advice from Tabmydata. We do not review or endorse it.

6. Data sources and third-party integrations

Tabmydata connects to multiple third-party cryptocurrency and financial exchanges and other third-party data providers (including news and sentiment sources) to provide aggregated market data. We do not own or control the data these third parties provide, and we are not responsible for it.

We do not guarantee that data from third-party sources will always be available.
You must follow the terms and conditions of any external exchange you connect to through the platform.
Tabmydata is not responsible for errors, outages or inaccuracies caused by third-party integrations.
Exchange, data provider and other third-party names and logos are trademarks of their owners. We use them only to identify the data source. Their use does not mean that those companies partner with or endorse Tabmydata.

7. Subscriptions and pricing

Some features of the Services may require a subscription or payment. If you subscribe, you agree that:

Subscription fees are non-refundable, unless stated otherwise.
We may change pricing or introduce new fees. We will give users notice in advance.
If you do not pay applicable fees, we may suspend or terminate your account.

8. Account security

You are responsible for keeping your login credentials secure.
We do not store sensitive financial information, such as private keys or exchange login details.
If you suspect unauthorized access to your account, you must notify us immediately.

9. Intellectual property

All content, software, trademarks and technology on the platform are owned by or licensed to Shining Dawn FZ-LLC.
Tabmydata and its logo are trademarks of Shining Dawn FZ-LLC. You may not use them without our permission.
We give you a personal, non-exclusive, non-transferable, revocable right to use the Services in line with these Terms.
You may not copy, modify, distribute, sell or exploit any part of the platform without our explicit permission.

10. Limitation of liability

To the maximum extent permitted by law, and subject to the last paragraph of this section, Tabmydata is not liable for:

Any losses, damages or missed opportunities that result from using the platform.
System failures, server downtime, data inaccuracies or third-party service disruptions.
Any financial losses caused by market movements, trading errors or investment decisions.
Indirect or consequential loss, loss of profit or loss of data.

Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100.

Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, death or personal injury, or any liability that cannot be limited by law, including your statutory consumer rights.

11. Termination and suspension

We may suspend or terminate a user account if:

These Terms are materially breached.
We detect or reasonably suspect fraudulent, abusive or suspicious activity.
Required payments for subscription-based services are not made.

Where reasonably possible we tell you why and give you a chance to respond, except where urgent action is needed for security, legal reasons or to protect other users. You can write to support@tabmydata.com to ask us to review the decision. You may delete your account at any time.

12. Changes to these Terms

We may update these Terms from time to time. We will post changes on our website. For material changes we will give you at least 30 days' notice by email or in the app before they take effect, unless the change is required by law or for security. If you do not agree, you can stop using the Services and delete your account before the change takes effect. If you keep using the Services after that date, the updated Terms apply.

13. Governing law

These Terms are governed by and interpreted under the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. Any dispute will be resolved through arbitration or in the competent courts of Ras Al Khaimah. Nothing in these Terms limits mandatory consumer protection rights, or any right you have to bring a claim in the courts of the place where you live.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Tabmydata about the Services. You may not transfer your rights under these Terms without our consent. Not enforcing a term is not a waiver of it. Sections 5, 9, 10 and 13 continue after termination. We are not liable for failures caused by events beyond our reasonable control. You may not use the Services where you are subject to applicable sanctions.
